UAE TRC for Domestic vs Tax Treaty Purposes

Why the Purpose Matters

A TRC application is not a one-size-fits-all form. The FTA explicitly distinguishes tax treaty purposes from domestic purposes, and the evidence path can change with the purpose selected.

Start with the Tax Residency Certificate UAE overview to understand the basics before choosing a purpose.

TRC for Tax Treaty Purposes vs Domestic Purposes

Tax Treaty Purpose

For a natural person, the current FTA FAQ states the applicant must be a UAE resident for at least 183 days during the required financial year.

For a legal person, the entity must have been established in the UAE for at least one year.

Domestic Purpose

The FTA FAQ identifies different day-count categories for natural persons applying for local/domestic purposes:

  • More than 183 days
  • Less than 183 days but more than 90 days
  • Less than 90 days

Different supporting documents apply to each category.

Which Documents Change?

The application can request different evidence according to the selected path.

🧑

Natural Persons

Entry/exit reports, permanent-place-of-residence evidence, income evidence, and financial/personal-interest evidence may become relevant.

🏢

Legal Persons

Corporate documents and financial evidence can be required.

See the full TRC application requirements for the complete document lists.

Do Not Copy Another Applicant’s Checklist

A colleague may have used an 183-day evidence set while another applicant is asked for documents under a different category. Use the actual purpose and facts of the application rather than treating a search result or a consultant checklist as universal.

How to Choose the Right Route

Step 1 — Identify who needs the certificate Natural person or legal person.
Step 2 — Identify why the certificate is being requested What is the intended purpose?
Step 3 — Identify the country or authority that will receive it Some jurisdictions have specific forms or requirements.
Step 4 — Determine the tax period / requested 12-month period Align with your financial year or the period requested by the foreign authority.
Step 5 — Review the FTA requirements for that combination Check the current FTA FAQ and manual for your exact scenario.

A Note on “Tax Domicile Certificate” Terminology

FTA pages and older terminology may use “tax domicile certificate” in places. On the AEY site, keep terminology clear: the current FTA service is the Tax Residency Certificate, and this article should not imply there are two separate UAE certificates unless an official source says so.
